August 13th, 2010:
Please be advised that foreclosure cases assigned to Justice Allen Hurkin-Torres, who has left the bench, will be assigned to Justices Johnny Lee Baynes and Noach Dear.

July 23rd, 2010:
Effective September 1st, 2010, motions in foreclosure actions should no longer be made returnable in the Foreclosure Motion Part. On or after this date, foreclosure motions should be made returnable directly to the assigned judge’s part. The Motion Support Office will then reschedule these motions to the assigned judge’s next available motion day for argument. Counsel may consult the New York Law Journal or the Unified Court System’s Future Court Appearance system for the rescheduled date.

Foreclosure motions that are accompanied by a new RJI, should be made returnable to "an IAS Part to be assigned". The Motion Support Office will randomly assign these motions and schedule them for the assigned judge’s next available motion day.

March 1st, 2010:
Commercial Foreclosure Actions (revision in italics):
Effective February 4th, 2010, new RJI's filed in commercial foreclosure actions will be assigned to Justice Robert J. Miller in Commercial Division Part 4. Litigants filing RJI's in these matters should clearly indicate that the nature of the proceeding is a “commercial foreclosure action” in either the “Other Commercial” or “Other Real Property” section of the RJI. Motions in these matters should be made returnable in Commercial Division Part 4, rather than the Foreclosure Motion Part, and counsel should consult either the Law Journal or the Unified Court System’s future court appearance system for the date assigned for oral argument. The RJI should also indicate whether there are any related actions pending in the Commercial Division so that an appropriate assignment of the case can be made.

If a commercial foreclosure action is assigned to a non-commercial part because the filing party did not designate the case as a "commercial foreclosure action" on the new RJI, any other party may apply by letter application (with a copy to all parties) to the Administrative Judge, within 10 (ten) days after receipt of a copy of the RJI, for a transfer of the case to Commercial Division Part 4. The determination of the Administrative Judge shall be final and subject to no further administrative review or appeal.

Commercial foreclosure actions, with RJIs filed prior to February 4, 2010, will remain with the previously assigned judge.
